Accused pair in Costa del Sol fatal hit-and-run found guilty of murder

The prosecution is asking for a 28-year prison sentence, and to pay the family of the deceased 22-year-old victim 100,000 euros in compensation

The two men accused of fatally running over a 22-year-old man after a fight in Benalmádena have been found guilty of his murder.

The jury came to its verdict unanimously following a two-week trial that started at Malaga's provincial court on 5 March. The jury members agreed the two defendants "sought revenge" when they ran over the victim and his then 19-year-old friend, who were riding a scooter at the time.

The incident happened in the early hours of 25 February 2017 following an argument and then a brawl between the victims and defendants at a pub in Solymar square. According to witness statements, both one of the defendants and also the young man who later lost his life were injured in the fight. National Police intervened and offered the accused to file a complaint, which he refused, as well as the offer of the officers to be accompanied to his car, which he left parked in a nearby street.

Instead, he and his friend planned to take revenge, according to the court verdict. They got into the car and, once they reached the junction of Avenida de Mijas and Avenida Antonio Machado, noticed the two victims on the scooter. The driver turned the car sharply in the direction of the scooter and ran over it at high speed, the court heard. The jury found the then 19-year-old driving the scooter - the one who survived the attack - had no space or time to avoid the impact. After smashing into the scooter, the defendants then reversed and ran over the scooter a second time, killing the 22-year-old, the court heard.

The prosecution requested the defendants be jailed for 26 years. The prosecuting lawyers, José Lorenzo and Miguel Ángel Ortiz, representing the family of the deceased, raised the sentence request to 28 years' in prison for each of the accused. They are also asking for 100,000 euros in damages for the young man's family.
