The young driver of a high-end Mercedes car is being held in custody after a 41-year-old cyclist died in Fuengirola on Monday night. The arrested man, who has held a driving licence for only one year, is a 20-year-old man of French nationality, who is being investigated for an alleged crime of reckless manslaughter.
SUR has learned there are two factors that would underpin the alleged recklessness of the driver. Firstly, excessive speed. Initial investigations suggest the car "widely" exceeded the 30 km/h speed limit on the road, that is also shared with bicycles.
Secondly, the driver is being investigated for allegedly driving under the influence of a narcotic substance. Although he tested negative for breath alcohol, the young man did test positive for drugs, specifically cannabis. However, the result must be confirmed by an analysis in a specialised laboratory.
The fatal accident happened at 8.50pm on Monday on Fuengirola’s Paseo Marítimo Rey de España, which was very crowded at the time. Witnesses alerted the emergency services to the incident which involved three vehicles, as well as the cyclist.
Several people attempted to perform first aid on the injured cyclist, assisted by firefighters, until paramedics arrived but, despite their efforts, they could do nothing to save his life.
The deceased man, from Cordoba, was 41 years old and was enjoying a family holiday in Fuengirola. He had gone out for a bike ride when the incident happened.
According to police investigations, the arrested man was at the wheel of a Mercedes car, with a Polish registration plate, along with two friends. They were not injured in the accident.
Apparently, for reasons that are still being investigated, the car hit a kerb and was launched into the air, hitting the cyclist, before landing – upside down – on top of another car and smashing into street furniture.
The council in Fuengirola has sent its condolences to the family of the cyclist and said on social media, “This incident is solely attributable to the conduct of the person behind the wheel of the vehicle causing the accident, as the first investigations indicate that it greatly exceeded the maximum speed allowed."
“The Town Hall and the local police will spare no effort bringing the perpetrator of this criminal act to face justice for this terrible event, which has cost the life of a person and has caused tremendous pain to their families and friends,” the statement ended.
