Brexit won't affect application of national law to wills

While there is great uncertainty surrounding many of the rights of British citizens living in other EU countries post Brexit, applying UK law to a will is not one, according to Sandra Wrightson of De Cotta Law. Anyone living in Spain has the right to decide whether their will should be executed according to Spanish law or that of their own country, regardless of the country. What may be affected, however, is the amount beneficiaries are taxed as the current Andalusian threshold only applies to residents from other EU member states. There are a number of differences between Spanish and UK laws regarding wills and like in the case of funerals, it is good to be prepared, said Wrightson.
