The former mayor of Marbella, Julián Muñoz, has followed in the footsteps of ex- Sevilla football club boss, José María del Nido, and announced that he will apply for a pardon. Del Nido, convicted of looting funds from Marbella Town Hall when he was a lawyer working under former mayor Jesús Gil y Gil, said that he would seek the pardon in a last-ditch attempt to avoid having to go to jail.
Now Muñoz, who has been convicted in the Blanqueo, Malaya and the Minutos cases, with others pending, has also applied for the pardon on the grounds that he is in poor health. He is 65 years old.
The Malaga provincial court has announced, however, that Muñoz will not be allowed out of prison while his pardon application is being considered by the Ministry of Justice. The former mayor is currently serving a seven-year sentence for the ‘Blanqueo’ case.
Meanwhile the president of the Andalusian High Court, Lorenzo del Río, pointed out that the pardon was an option that could only be granted by the government in “very exceptional” cases. He described the pardon as a “historical remnant” that should never be used in a “discretionary” manner.
