A Marbella court has ordered the Molding Clinic to pay 66,591 euros in damages to a British woman whose breast implant exploded after a reconstruction operation in 2003. The patient had previously had a mastectomy due to breast cancer. While the judge found that there was no evidence of negligence on the part of the surgeon in question or that the treatment had been “inadequate”, he did decide that the patient had not been given enough information about the consequences of the surgery.
The damages were awarded for breach of contract as the clinic had promised results that it could not produce and the situation caused the woman to suffer from “severe depression”. The patient returned to the clinic just over a week after the silicon implant had been fitted with a high fever and inflammation.
