A national court in Madrid has rejected Malaga City’s Hall’s bid for the ownership of the former Campamento Benítez military camp (near the Torremolinos border), ruling that the land belongs to the Ministry of Development.

The Mayor, Francisco de la Torre, took the matter to court when negotiations between city and government broke down. The City Hall’s argument is that the land was lent to the Ministry of War in 1924 for military use. As in 1995 the Ministry of Defence decided that the 28 hectares would no longer be used as an army training camp, the local authority concludes that the land should be returned to the municipality. The judge has ruled against this petition on the grounds that the document signed in 1924 did not specify what the land was to be used for.

The Mayor will appeal against the sentence, but this will not affect the Ministry’s plans to build a transport museum on part of the land.
